1. Acceptance of Terms
By downloading, installing, or using Text Automator ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Description of Service
Text Automator is a mobile application developed by CodePixel Labs LLC ("we," "us," or "our") that provides SMS automation tools for Android devices, including:
- Scheduled SMS: Send recurring text messages to contacts on days and times you choose
- Auto-Reply: Automatically send replies to incoming SMS messages based on rules you configure
- Auto-Forward: Automatically forward incoming SMS messages to other phone numbers based on rules you configure
- Group Messaging: Send a single message to multiple contacts at once
The App operates locally on your device and does not require an internet connection for core functionality.
3. User Responsibilities
You are solely responsible for:
- All messages sent through the App, including messages sent automatically by the Auto-Reply and Auto-Forward features on your behalf
- Ensuring the accuracy of recipient phone numbers and message content
- Obtaining any required consent from recipients before sending them automated messages
- Complying with all applicable federal, state, and local laws regarding SMS and electronic communications, including but not limited to the Telephone Consumer Protection Act (TCPA) and any applicable anti-spam regulations
- Configuring Auto-Reply and Auto-Forward rules responsibly to avoid unintended messaging
4. Prohibited Uses
You agree not to use the App to:
- Send unsolicited bulk messages (spam)
- Harass, threaten, or abuse any person
- Send fraudulent, deceptive, or phishing messages
- Impersonate any person or entity
- Violate any applicable law or regulation
- Interfere with or circumvent the App's safety features, including loop protection and frequency limits
- Use the App for any commercial bulk messaging or telemarketing purpose without proper authorization and recipient consent
We reserve the right to report illegal activity to appropriate authorities if we become aware of it.
5. SMS and Carrier Charges
The App sends SMS messages through your device's native messaging capabilities. Standard messaging rates from your mobile carrier apply to every message sent, including messages sent automatically by the Auto-Reply, Auto-Forward, and scheduled SMS features. You are responsible for all carrier charges incurred through use of the App. CodePixel Labs LLC is not responsible for any charges from your mobile carrier.
6. Message Delivery
While the App is designed to reliably send scheduled and automated messages, CodePixel Labs LLC does not guarantee delivery of any message. Message delivery depends on factors outside our control, including but not limited to:
- Device power state and battery level
- Mobile network availability and carrier restrictions
- Android operating system behavior and battery optimization settings
- Device storage availability
- Recipient phone number validity and carrier filtering
You acknowledge that automated messages (Auto-Reply, Auto-Forward) depend on the App's background services remaining active, which may be affected by your device's power management settings.
7. Premium Subscription
The App offers an optional premium subscription that removes usage limits on certain features. By purchasing a subscription:
- Payment is processed through the Google Play Store and is subject to Google Play's Terms of Service
- Subscription pricing and billing intervals are displayed in the App and on the Google Play Store before purchase
- Refund requests are handled according to Google Play's refund policies
- We reserve the right to change subscription pricing; any price changes will not affect active subscription periods
- You may cancel your subscription at any time through the Google Play Store
8. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.
9. Intellectual Property
The App, including its design, code, graphics, and content, is the property of CodePixel Labs LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or reverse-engineer the App or any part of it.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CODEPIXEL LABS LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CODEPIXEL LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR FAILED OR DELAYED MESSAGE DELIVERY, UNINTENDED MESSAGES SENT BY AUTOMATED FEATURES, CARRIER CHARGES, OR LOSS OF DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR ITS PREMIUM SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless CodePixel Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) any messages sent through the App, including automated messages; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.
13. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be reflected in the "Last Updated" date above. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify users through the App or our website.
14. Termination
You may stop using the App at any time by uninstalling it from your device. All data stored within the App's private storage will be removed upon uninstallation. Backup files you have exported and saved outside the App (for example, to your Downloads folder or cloud storage) are under your control and will not be affected by uninstallation. We reserve the right to disable access to premium features if we determine that you have violated these Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the State of Texas.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CodePixel Labs LLC regarding your use of the App and supersede any prior agreements.
